Cultivation, sale, storage and export: who and how can legally use hemp

Ukrainian deputies are actively preparing for the legalization of medical cannabis. The text of the bill has already appeared on the website of the Verkhovna Rada № 7457 with a long name "On the regulation of the circulation of plants of the genus Cannabis (Cannabis) for medical, industrial purposes, scientific and scientific and technical activities to create conditions for expanding patients' access to the necessary treatment of oncological diseases and post-traumatic stress disorders resulting from the war". Let's analyze its main points.

The draft law assumes that the circulation of plant varieties and products of their processing, as well as manufactured medicines allowed in scientific and scientific and technical activities, as well as in medical practice.

They plan to track the turnover of cannabis by:

  • markings each batch and unit of packaged products;
  • creating and maintaining electronic register of turnover and movement of plants or medicines derived from them;
  • ensure the sale of medicines exclusively on doctor's orders and in accordance with the electronic prescription.

Sell ​​these drugs pharmacies of all forms of ownership will be able to do so if they have a license.

It is proposed to prohibit the cultivation of relevant plants on the territory of Ukraine, with the exception of plants that contain small amounts of narcotic substances, and plants of the hemp genus that contain narcotic drugs and psychotropic substances, the circulation of which is allowed for medical purposes in compliance with the law.

Cultivate hemp will have the right of a legal entity of all forms of ownership if they have an appropriate license within the quotas determined by the Cabinet of Ministers of Ukraine. These legal entities will be required to take measures to ensure the protection of crops, places of storage and processing of plants established by law.

Planned allow activities to develop new narcotic or psychotropic substances. Scientific institutions of state, communal and private forms of ownership will have the right to do so only for the use of results for medical purposes or for scientific and scientific-technical activities. New drugs can be used subject to their state registration and conducting clinical trials in accordance with the law.

Production, manufacture, sale and export from the territory of Ukraine of such narcotic drugs and psychotropic substances is proposed to be allowed only on the orders of business entities licensed to use such narcotic drugs and (or) psychotropic substances, or health care institutions of other countries whose legislation allows the import of such substances into their customs territory.

The transport of such substances may only be carried out by order or directly by persons licensed to manufacture, manufacture and / or use them. Only legal entities of all forms of ownership will be able to carry out the relevant activities if they have a license for the implementation of relevant activities.

A patient who enters / leaves Ukraine will have the right to import / export the relevant substances in volumes not exceeding those prescribed by his prescriptionswithout the need for additional permissions. In the same volumes, an individual will have the right to store these substances at home.

Transit through the territory of Ukraine of narcotic drugs, psychotropic substances or precursors can be carried out with their mandatory protection and escort by the relevant units of the National Police.

The explanatory note to the bill states, among other things, that its adoption will help attract international investment in Ukrainian science and industry.

Recall that in July 2021, the Verkhovna Rada failed the legalization of medical cannabis in Ukraine by sending a bill № 5586 for revision.

Note that both bills were initiated by Prime Minister of Ukraine Denys Shmyhal.
