Violation of the laws and customs of war: Ukrainian teachers in the de-occupied territories will be tried as collaborators
Ukrainian teachers who decide to cooperate with the Russian Federation face criminal liability.

In the territories de-occupied by the Armed Forces of Ukraine in the Kharkiv and Kherson regions, both Russian teachers who came to “establish” the educational process according to the Russian education program, and Ukrainian teachers who decided to cooperate with the Russian Federation are detained. All of them face criminal charges.. About it live unified news marathon Minister for Reintegration of the Temporarily Occupied Territories of Ukraine Irina Vereshchuk.
Such people face criminal liability in accordance with Article 438 of the Criminal Code of Ukraine "Violation of the laws and customs of war».
“They committed a crime against our state. We have repeatedly warned Russian citizens who agreed to come to the territory of Ukraine and carry out activities prohibited by law. The degree of punishment will be determined by the court. No one will treat them as prisoners, because they are not combatants, the Geneva Conventions do not provide for the exchange of non-prisoners of war"- Vereshchuk noted.
According to the sanction provided for in Article 438 of the Criminal Code, Russian teachers face 8 to 12 years in prison.
At the same time, criminal liability awaits teachers who agreed to go over to the side of the Russian Federation. In addition to teachers of secondary schools, teachers of higher education institutions should also be held accountable, the First Deputy Chairman of the Verkhovna Rada Committee on Humanitarian and Information Policy is convinced Irina Konstankevich. She believes that for the conscious choice to serve the criminal interests of Russia, the perpetrators should be punished at all levels.
Note that this is not the first statement by the authorities about teachers who agreed to cooperate with Russia. Earlier it was reported that teachers in the territories controlled by Russian troops could be held accountable for cooperation with the Russian Federation. This will be done if teachers start teaching subjects according to Russian educational programs.
This was stated by the head of the VR Committee on Education, Science and Innovation Sergei Babak briefing on August 31st. "Teachers who try to start studying according to Russian programs, according to our legislation, are equated with collaborators and are subject to the Criminal Code of Ukraine with all the negative consequences,” — said he.
People's Deputy stressed that this does not apply to children, because “children at a young age do not understand what is happening”. He also added that the authorities understand that parents can be intimidated, and children go to school under duress. Babak noted that most teachers in settlements in the occupied territory refuse to work with local "authorities".
What does the education ombudsman say?
Sergey Gorbachev, the Ombudsman for Education, stated that does not see the systemic policy of the Ministry of Education and Science of Ukraine to support Ukrainian teachers in the territories controlled by the Russian troops.
“Teachers in these territories are suffering very much, and children are suffering because they are deprived of education. But here, unfortunately, I also do not see the systemic policy of our ministry to support our teachers who were forced to remain in the occupied territories.- said he during a panel discussion on the topic: "Protection of the rights and interests of children in times of war."
The Ombudsman noted that Ukraine actually cannot effectively influence the situation with education in the territories controlled by the Russian troopsbut can support children and teachers. Earlier, he stated that patriotic fellow citizens who are in such territories and do not succumb to pressure from the "authorities" now need urgent and special support from the state. They should know that the Ukrainian authorities did not leave them to their fate with these super complex problems.
Recall that Ukraine will impose sanctions against teachers from the occupied territories who have sided with the enemy. Restrictions are also being introduced against “educational institutions” operating according to the “educational standards” of Russia. This is reported with reference to Ministry of Reintegration.
The corresponding decision was made by the Cabinet of Ministers at a meeting on September 2. The format of the sanctions will be considered by the National Security and Defense Council.
“Teachers and educational institutions at the VOT who disseminated educational standards of the Russian Federation and recognize educational qualifications awarded by higher education institutions of the Russian Federation are subject to special economic and other sanctions for a period of 5 years”, the message says. Russian universities, their leaders and scientists who spread war propaganda also fell under Ukrainian sanctions. In total, sanctions were imposed against 81 individuals and 53 legal entities.
